sons x gf wants him to pay support 4 child she claims is his can he get visitation we live in NC she is in TN?
She is on welfare and has had him served. She keeps telling him that he will not be able to see the child and will have to pay back support 4 the last year plus med. He is distressed and I have no idea what his rights are. If it is his he wants to support her but he wants to be in the childs life also
When it comes to child support, never ever trust a female that says a) the child is your’s, and b) “I don’t want child support”.
He needs to demand a dna paternity test before he gives her a dime. He shouldn’t even acknowedge the child to be his until the court confirms the dna test says he is the biological father. The world is full of fathers paying child support for a child that is not biologically theirs and they have no rights over.
Once he is officially the daddy, he needs to file for visitation rights AND pay child support. By the way, the mother cannot refuse him access to the child ONCE it has been determined he is the father (he has no rights until paternity has been confirmed). In my humble opinion, he should take her to court and sue for custody because she obviously knew who he was and yet refused to inform him that he possibly had a child. She denied him his right to access his child.
At the very least, he has the right to ask for visitation and it will be awarded. And then if the mother still refuses to let him visit with his child, he needs to take her back to court and have the court put her into contempt…and then go for custody!
As for what will be “awarded”, the courts will decide the appropriate amount of child support. I don’t know if they will add on extra for health care or medicine. He will need to consult a good lawyer. As to whether or not he will have to pay for the past year, he could make the argument that the mother refused to tell him that he was a parent until now and thus deprived him of access (as in, he is good enough for the money but not good enough (according to her) to place an active role in his child’s life). I expect he will lose but it might be worth a try.
I think your son needs a) a good lawyer, and b) lessons on contraceptives (if he refuses to wait until marriage)…assuming the child is his in the first place, which it may not be.
